Claims substantiation in India from 2026: what changes for collagen brands
India's tightening requirement for scientific backing on health claims alters what a collagen brand can say — and shifts advantage toward ingredients with a real evidence base.
Indian nutraceutical brands have operated for years in a claims environment that was permissive in practice if not in principle. That is changing. From 2026, companies are required to hold scientific substantiation for health claims made on labels and in marketing.
For most of the category this is an inconvenience. For collagen specifically, it is a sorting mechanism.
What substantiation actually requires
A substantiated claim needs three things: a defined ingredient, a defined dose, and evidence that the ingredient at that dose produces the claimed effect in a relevant population.
Each of those is a place where a claim fails.
The ingredient must be defined. "Collagen" is not a specification. Type, source, molecular weight distribution and purity all vary enormously between products sold under the same word. Evidence generated on a 2,000 Da fish peptide does not automatically transfer to a 10,000 Da bovine hydrolysate.
The dose must match. Published trials use doses that range across more than an order of magnitude. A product delivering 1 g per serving cannot lean on a trial that used 10 g, and the gap between typical Indian retail dosing and clinical dosing is one of the least discussed problems in the category.
The population should be relevant. Most collagen trials recruit women aged roughly 30 to 60. Claims aimed at other groups rest on weaker ground.
Where this leaves the three collagen categories
Marine and bovine peptides have a genuine literature. A meta-analysis in the Indian Journal of Dermatology, Venereology and Leprology pooled ten randomised controlled trials across 646 participants and found statistically significant effects on skin hydration and elasticity. That is a real foundation — though it substantiates the class, not any particular product.
Plant-based collagen builders are in a different position. These products contain no collagen. They supply vitamin C, amino acids and botanical extracts intended to support the body's own synthesis. That is a legitimate mechanism, but it is a different mechanism, and the evidence base for "supports collagen production" is not the evidence base for collagen peptide supplementation. Brands that have borrowed the latter to market the former have a problem coming.
Undefined or unspecified collagen — material bought on price with no molecular weight data and no certificate of analysis — cannot be substantiated at all, because the first requirement is a defined ingredient.
What this means practically for procurement
The substantiation burden sits with the brand, but it is met or missed at the point of ingredient purchase. Three questions worth asking any supplier:
- What is the molecular weight distribution, batch to batch? Not the average. The distribution, with variation across consecutive lots.
- Can you provide certificates of analysis for several sequential batches? One good certificate proves one good batch.
- What documentation supports the origin claim? Species, region and traceability, because origin claims are claims too.
A supplier who cannot answer those is not a cheaper supplier. They are a supplier whose material cannot carry a claim.
The wider effect
Tightening substantiation tends to consolidate categories. Brands with documented ingredients and real dosing survive it; brands built on vague claims and thin dosing do not. For anyone selling a properly specified collagen peptide at a clinically plausible dose, the regulation is a competitive advantage rather than a cost.
That is an unusual position for a regulation to put a supplier in, and it is worth recognising while the window is open.
